BMW vs DMW: BMW Group Wins the Trademark Violation Case

As per the recent reports, the BMW Group has won the case of trademark violation filed by the brand against DMW, an electric vehicle manufacturer. Since DMW sounds almost identical to the very famous BMW, the latter decided to take the matter to the court and have finally succeeded in their appeal. The DMW brand name was registered in 2013 by Om Balajee Automobile India Private Limited and BMW has filed a case against the electric firm for a potential proprietary violation with the Delhi High Court back in 2017. The argument presented by BMW in the court clearly stated that DMW, an all-new electric wheeler manufacturer is trying to gain popularity in the markets with their brand name sounding almost similar to the already established brand that has a global sales network and a potent foothold in more than 140 countries across the world. The reports further state that the DMW Group powered by the Om Balajee Automobile India Private Limited counter-attacked by putting up an argument that the brand name was registered in 2013 and BMW has filed a case after a gap of four years though the court has dismissed the argument further. According to the final decision made by the High Court, registering an identical name as that of an established brand with millions of worth will simply mislead an average man with ordinary intelligence. With the decision of the court finally in favour of BMW, the officials at the DMW have been charged with the violation of trademark rights and are found guilty. Not only DMW, but a Chinese firm by the name “BMN” and a similar logo as that of BMW were also found guilty of breaking the trademark rights a few years back and had to pay 3 Million Yuan as compensation.
